A Mombasa high court judge John Onyiego early in May ruled that both parents should have an equal share of the custody.
In the ruling, the judge specified that any party that fails to comply with his ruling would be held accountable.
Since the ruling was delivered the mother of the baby vanished with the child, the Briton has not seen him again.
The minor, who the judge ruled should be shared by his estranged parents, was stolen by the mother seven weeks ago.
A clear contempt of Justice Onyiego order.
According to sources the father, a British former intelligence officer, had lodged a child stealing report with the police but claims he was frustrated by the judge who is lackadaisical about issuing a warrant of arrest for the woman.
In mid April, a Mombasa High Court Justice John Onyiego appended a penal notice to parents who had been awarded shared custody that any party that fails to comply would be liable for a fine or imprisonment for a period not exceeding six months or both.
The mother who is battling over his custody with a former Scotland Yard detective took the first turn and has promptly vanished ever since.
With no option but to seek a warrant of arrest for the woman, the father reportedly headed back to court, but the the Judge has always been hesitant to issue a warrant of arrest despite several applications.
But sources who spoke to us on condition of anonymity intimate that Justice John Onyiego, after weeks of procrastination, would have to finally address the issue as in the application and may have to eat humble pie and issue the warrant.
The Briton had, during the trial, raised integrity issues with the judge accusing him of bias and applied to have the judge recuse himself from hearing the case which justice Onyiego ignored.
According to his application which sought to bar Justice Anyiego from handling a case in which he had earlier ruled that the child be handed over to the mother, an exercise that failed due to a technicality, the former intelligence officer accused Justice Onyiego of bias and compromised.
Court records indicate there was a mental examination application to assess the stability of the mother.
In his affidavit the Briton had stated that his estranged wife had threatened to kill him.
He added that the mother had squandered Ksh 10 million in the child joint account.
